1. Definitions

In these conditions, the following shall mean:

AiChatify: The service provider who provides the software.
Customer: The natural person or legal entity that subscribes to a subscription with AiChatify.
Service: The software solution for chatbots, heatmaps, and behavioral analysis.

2. Use of the Service

2.1. AiChatify grants Customer a non-exclusive, non-transferable right to use the software for their own website(s).

2.2. It is not allowed to use the service for illegal purposes, distributing malware, or collecting sensitive personal data (such as medical data or BSN numbers) contrary to the law.

3. Fair Use Policy

3.1. To ensure the quality and speed of our service for everyone, we apply a Fair Use Policy.

3.2. For subscriptions with "Unlimited chats", there is a limit of 10,000 chats per month. If this limit is exceeded, we will contact you to discuss a fitting Enterprise solution.

3.3. AiChatify reserves the right to temporarily restrict accounts in case of extreme data traffic that jeopardizes the stability of the platform.

4. Payment and Termination

4.1. Subscriptions are billed in advance per month or per year.

4.2. Cancellation is possible at any time via the dashboard. The subscription will then continue until the end of the already paid period.

4.3. We offer a 14-day 'Money Back Guarantee' on the first payment.

5. Liability

5.1. AiChatify strives to achieve a 99.9% uptime, but cannot guarantee uninterrupted availability.

5.2. AiChatify is not liable for direct or indirect damages resulting from the use of the software, unless there is intent or gross negligence on our part.

5.3. The Customer is responsible for properly informing their own website visitors about the use of cookies and analytics tools (for example, through a cookie banner).
